Apple Seeking Wider Samsung Products Import ban in The US

On August 9, Samsung took a legal blow as the ITC ruled it had violated two of Apple’s patents, something leading to an import ban against certain products. Though Apple had successfully had an ITC product ban overturned by the Obama administration, Samsung wasn’t so lucky with its own request, and now Apple is seeking a wider import ban in the US.

Apple has filed its Notice of Appeal and Petition for Review, something that was submitted last week and recently made available, with the folks over at FOSS Patents spotting the filing. With this submission, Apple has escalated its legal battle to the Federal Circuit, and is taking aim at ITC rulings that Samsung can pursue workarounds to side-step the products ban, as well as adding more devices to the list.

In the August 9 decision, it was ruled that Samsung did not infringe upon four of Apple’s patents that were part of the case, though the Korean company was saddled with two infringement charges. Both of the patents were related to touchscreen multi-touch and headset plug detection, with both tablets and smartphones running afoul of it.

Samsung tried to have the Obama administration overturn the ruling, with the reason being that the ban on the devices was against the public interest. The Obama administration didn’t roll with this, however, with Michael Froman stating: “After carefully weighing policy considerations, including the impact on consumers and competition, advice from agencies, and information from interested parties, I have decided to allow [the ban].”
